Terms of service
Welcome to the online platform services provided by the LOX website (referred to below as ‘LOX’ and the ‘Service’).

By beginning to use the Service, you acknowledge that you have read, understood and agreed to all LOX terms of service (the ‘Terms’). LOX reserves the right to amend or change the rules governing the Service. Continuing to use the Service after an amendment or change constitutes acknowledgement that you have read, understood and accepted it. If you do not agree to these rules, or if your country or region excludes their application, you must stop using the Service immediately.
If you are under 20 years of age, your parent or guardian must read, understand and agree to all rules governing the Service, including subsequent amendments, before you may use or continue using it. Your use or continued use is deemed to mean that your legal representative has read, understood and accepted these rules and subsequent amendments.

The rules governing the Service are as follows:

1. Basic agreement
When registering for or using the Service, provide the accurate and complete personal information requested by LOX and update it whenever it changes.

If any information you provide is incorrect, false or incomplete, LOX reserves the right to suspend or terminate your access and prohibit you from using all or part of the Service.

To prevent malicious programs or other attempts to undermine fairness on LOX, LOX may immediately suspend or permanently terminate an account if it discovers, or receives a third-party report of, cheating or a violation of these Terms.

Your registered LOX account is not transferable. Any rights associated with the account or its contents end immediately upon the applicant’s death. When LOX receives relevant proof of death, the account will be terminated and all its contents permanently deleted.

You are responsible for maintaining the confidentiality and security of your password and account. You agree that, if your password or account is impersonated, stolen or otherwise compromised, LOX will, upon notification and in accordance with the law, immediately suspend the processing and subsequent use of transactions arising from that account.

2. User obligations
LOX is an online platform providing public services. When using its services, you must comply with the laws of the Republic of China and applicable international treaties and practices. When using websites established outside Taiwan, you must also comply with their local laws and online practices. You are solely legally responsible for statements you publish and actions you take online, independently of LOX. If you use the Service to infringe the rights of LOX or a third party, or engage in other unlawful conduct, LOX will stop providing you with the Service and may refer the matter to prosecutors or police for investigation.
LOX activities are conducted on principles of fairness and openness. Cheating is prohibited, and you must follow each activity’s rules. If LOX discovers, or a third party reports, malicious programs or conduct intended to manipulate activity or competition results or undermine fairness, LOX may immediately cancel eligibility and recover prizes or prize money. Participants must provide truthful information and consent to LOX collecting their personal information. If incomplete or incorrect information prevents notification, or if you do not reply to email, you will be deemed to have voluntarily waived your eligibility, and any prize will not be reissued. Confirm that your email address is correct before submitting personal information. LOX retains the right to review participant eligibility and select winners for all activities. If a review finds a participant ineligible, LOX may cancel their participation or award.

3. User rules and prohibited conduct
Users must not publish the following content:

Transmitting or communicating unlawful content is prohibited. LOX strictly prohibits text, images, files or other inappropriate content on the Service that is harassing, offensive, defamatory, violent or discriminatory, including public insults, violence, coercion, threats, intimidation, false defamation, indecency, pornography or obscenity, or that unlawfully infringes others’ rights, incites crime or violates public order or good morals.

Using improper transmission methods or systems, plug-in software, viruses or similar means to conduct inappropriate activity within the Service is prohibited. This includes detection, cracking, destruction, reproduction, scanning, restoration, decompilation, disassembly, spam, malicious software or viruses in an attempt to obtain improper benefits or information or cause inconvenience to others.

Publishing titles, subtitles or other content that could mislead third parties into believing it is an official Service announcement is prohibited.

Publishing restricted content or content unsuitable for children or adolescents is prohibited. Such content includes:
a. Excessively explicit or direct depictions of sexual organs or acts, or images, photographs or videos exposing intimate parts.
b. Content that objectively stimulates or satisfies sexual desire and causes ordinary people shame or disgust, thereby offending sexual morality or public decency.
c. Content that violates Article 235 of the Republic of China Criminal Code, Articles 27, 28 or 29 of the Child and Youth Sexual Transaction Prevention Act, or other relevant laws.

Discriminatory content is prohibited. Users must not publish inflammatory discrimination against a particular group based on religion, race or ethnicity, sex, age, physical or mental disability, sexual orientation, or other factors contrary to public order or good morals.

Content suspected of infringing another person’s reputation, credit, privacy, trade secrets, intellectual property or other rights is prohibited.

Online transactions and unlawful or false advertisements must not be published on the blog.

Publishing unlawful or false advertisements, prohibited or restricted online transactions (see the list of goods prohibited from online sale and the list of goods restricted from sale listings on the website), false content or content encouraging crime is prohibited.

Other published or transmitted content or conduct that LOX considers inappropriate for legitimate reasons is also prohibited.

LOX does not review ordinary users’ publicly available content or information in advance, but may, at its discretion, refuse or remove any content provided through the Service. Without limiting the foregoing, LOX and its designated parties may remove content suspected of violating these Terms or the law, or content that is objectionable.
Users or content providers are responsible for prohibited or other inappropriate conduct undertaken through the Service, including errors or omissions and any loss or damage arising from posting, emailing or transmitting content through the Service.

4. Personal information protection
By using the Service, you agree that LOX may access or disclose users’ personal information and communications to meet legal requirements or national policy needs. Your use also constitutes agreement to transfer that information outside Taiwan. LOX reserves the right to use, access, retain and disclose personal information when it reasonably considers this necessary. If a user is involved in unlawful activity, LOX will notify relevant judicial or police authorities, or retain or disclose personal information or ‘provided content’ to government agencies, judicial police or a minor’s legal representative for lawful purposes and within the necessary scope to provide reasonable and necessary assistance.
LOX respects privacy and will protect, as far as possible, personal information left through use of its services. Please refer to the Privacy Statement for details.

To protect members’ personal information, privacy and consumer rights, personal information will be used during transactions. The following notice is provided under Article 8 of the Personal Data Protection Act:

Purposes of collection: marketing, consumer and customer management and services, online shopping and other e-commerce services, surveys, statistics and research analysis (statutory specific-purpose codes 040, 090, 148 and 157). LOX collects personal information during membership registration or transactions.

Categories of personal information collected: (1) C001 — personal identification, such as a member’s name, address, telephone number and email; (2) C002 — financial identification, such as credit card or financial institution account information; (3) C011 — personal description, such as sex and date of birth.

Duration, region, recipients and methods of use:
(1) Duration: until the member requests that use stop or LOX stops providing the Service.
(2) Region: members’ personal information will be used in Taiwan.
(3) Recipients and methods: in addition to membership and customer management and related searches, information will be used for identification, payment services, logistics, advertising and marketing. Examples include:
a. Automatically displaying member information on pages when members use LOX services.
b. Completing transactions: when members reserve, bid on or purchase goods or services, participate in prize activities or conduct other transactions, information is used for delivery, service provision, payment, replies to customer questions, LOX enquiries to members, after-sales service and other business necessary to complete transactions.
c. Advertising and marketing: providing electronic magazines and other information, and service-related information by email, post or telephone; personalizing content or advertisements based on personal characteristics, purchase history or LOX browsing history; analysing service use; developing new services or improving existing ones; and contacting members about surveys, activities, message board opinions or other service-related matters.
d. Responding to customer questions submitted to LOX by email, post, fax, telephone or any other direct or indirect contact method.
e. Other ancillary business: use necessary to provide LOX services in connection with purposes a–d above.
f. Providing information to individual service providers: when members reserve, bid on or purchase a provider’s goods or services, join prize activities or apply for other transactions, LOX may provide their personal information files to that provider to the extent necessary for the transaction. The provider is responsible for managing those files. LOX will require providers by agreement to handle personal information in accordance with principles protecting member privacy, but cannot guarantee compliance. Contact each provider for details.
g. Other uses: individual services may use personal information for purposes beyond those stated above. In that case, the relevant details will be stated on the page for that service.

Members’ rights regarding personal information: under the Personal Data Protection Act, individuals whose personal information LOX collects may exercise the following rights against LOX: (1) enquire about or request access; (2) request a copy; (3) request supplementation or correction; (4) request that collection, processing or use stop; and (5) request deletion. Contact LOX customer service to apply to exercise these rights.

Please note: refusing to provide information necessary for membership may prevent you from receiving the full Service or using it at all.

5. Intellectual property protection
LOX does not own or control user-provided ‘Content’ transmitted, posted or displayed through the Service. Users or third-party licensors retain, as applicable, patents, registered trademarks, copyright and other intellectual property rights in the Content they submit, post or display. By publicly submitting, posting or displaying Content through the Service, you grant LOX a worldwide, non-exclusive, royalty-free licence, and agree that LOX may use, modify, reproduce, publicly broadcast, adapt, distribute, issue, publicly publish, publicly transmit, publicly screen or translate it, and exercise derivative copyright rights for display, distribution or marketing purposes. LOX may sublicense these rights within that scope. You warrant that these actions will not cause LOX to infringe any third party’s intellectual property rights; otherwise, you must compensate LOX for resulting damage. LOX also reserves, at its sole discretion, the right to refuse to accept, post, display or transmit Content. If someone uses the Service to infringe your intellectual property rights, inform LOX through ‘Contact us’, and service staff will assist as soon as possible.

6. Protection of children and adolescents
LOX provides a tool for finding online resources and a publishing platform. Respecting users’ right to choose information, LOX generally does not proactively review or filter search content in advance. However, the internet inevitably contains information unsuitable for children and adolescents, such as pornography or violence. LOX will refer websites providing harmful information to prosecutors or police, or remove their links, in accordance with its principles for handling links to websites with unlawful content.
Parents or guardians should carefully choose suitable websites and accompany children and adolescents where possible. Along with selecting websites, remind them not to disclose their own or their family’s information online and not to meet online contacts alone. Parents should remain present throughout internet use by children under 12 and consider whether to consent before adolescents aged 12 to under 18 use the internet.

7. Use of the service system
The service system and related software are provided ‘as is’ and ‘as available’, and you bear the associated risks of use. LOX does not guarantee the accuracy, completeness or quality of the Service. Interruptions or failures may occur when using the Service or signing in through a third-party website account, potentially causing inconvenience, loss of information, errors, tampering or other economic loss. Take protective measures and comply with the relevant rules. Except in cases of intentional misconduct or gross negligence, LOX is not liable for damage caused by using or being unable to use the Service.
The Service and system, including software, may contain security components protecting digital information. Such information must be used according to the rules specified by LOX or the content provider. Users must not attempt to disable or circumvent rules built into the Service. Reproducing, issuing, distributing or publicly displaying all or part of information provided by the Service without lawful authorization is strictly prohibited.

8. Improper transfer of electronic records
If you discover unlawful use of your account or password and improper transfer of electronic records of member activity, notify LOX immediately for verification. After confirming your identity, LOX will immediately freeze the account temporarily and temporarily restrict the relevant account users’ access to the Service.
If LOX knows the transfer history or the identity of a third party holding those records, it will notify that third party in writing or by email to provide an explanation when the temporary restriction begins. If the third party does not explain within seven days of receiving notice, LOX may decide whether to restore the improperly transferred records directly to you and lift the related account restrictions after restoration. If the third party disagrees with this procedure, LOX may follow reporting procedures and seek a judicial resolution.
LOX will not charge you during a restriction imposed under the first paragraph. If a false report by you damages the rights of LOX or other users, you bear all legal responsibility.

9. Advertisements
Descriptions, sample displays and other sales information in advertisements, text and images on the Service are provided by the respective advertisers or product and service providers, independently of LOX. Assess the accuracy and credibility of each advertisement yourself.

10. Purchases, sales and other transactions
Businesses or individuals may offer goods, services or other transactions through the Service or linked websites. If you transact with them, the purchase or other contract exists solely between you and the respective business or individual, independently of LOX. Obtain detailed information in advance from that party about quality, content, delivery, warranties and liability for defects. Seek a remedy or resolution from the respective business or individual for disputes arising from such purchases, services or other transactions. LOX declares that it does not intervene in these transactions and provides no warranty for goods, services or other transaction items you obtain.

11. Disclaimer
Publishing false information, fraud or extortion through ‘this website’ is the individual user’s conduct. The website is not responsible for disputes arising from it.

Disclosure of personal information caused by other websites linked to this website, and resulting legal disputes or consequences, are unrelated to this website.

This website charges members advertising fees for use of its transaction platform and limited customer service assistance in coordinating transactions. These fees do not include transaction guarantee fees.

Users’ entry of personal information or item information and uploading of photographs are their individual actions. This website is not responsible for the truthfulness or completeness of that content.

You use the Service at your own risk. Users agree that use of the website’s services is voluntary and that they bear all associated risks, including loss of resources resulting from downloading information or images from the website or obtaining information through its services.

This website provides no express or implied warranties for its services. It does not guarantee their stability, security, accuracy or uninterrupted availability. Users expressly assume all risks of use and any resulting damage.

For items sold or rented, or other services offered, through this website, the website provides no warranty against defects in the transaction process or the items or services themselves. Users understand that the provider is solely responsible for items or services purchased or rented through the website, and that defects or warranty obligations are unrelated to this website.

This website is not responsible for disclosure, loss, theft or alteration of information resulting from hacking, computer virus intrusion or outbreaks, temporary closure due to government control, or other force majeure affecting normal online operations.

Personal advertisements, commercial advertisements and product promotions on the website are provided by the respective individuals, advertisers or product and service providers, unless the website itself sells the items. The website is not responsible for resulting disputes and serves only as a publishing medium.

12. Other management rules and judicial investigations
LOX does not recognize the justification or legality of conduct that infringes public or individual interests. Users must not use the Service to infringe any website, group or individual, or invoke a mistaken understanding of freedom to justify incorrect facts. Once such conduct or a violation of the Service rules is established, LOX may take appropriate measures under its procedures for handling violations. If serious circumstances lead to court proceedings, the user bears full legal responsibility. LOX will also retain or disclose personal information, including communications and member content, to government agencies, judicial police or a minor’s legal representative as required by law or within the scope reasonably necessary for the stated purposes, to provide reasonable and necessary assistance.

13. Other provisions
Unless otherwise provided by law, interpretation and application of these Terms and related disputes are governed by the laws of the Republic of China, with the Taiwan Tainan District Court having jurisdiction at first instance. Headings are provided for convenience only and have no legal or contractual effect. Contact us immediately if you discover a violation of these Terms.

Purposes and categories of personal information collection

Depending on the nature of each service, LOX may collect your name, contact information (including telephone number, email and address), information needed to receive or make payments, and other information that directly or indirectly identifies users, for e-commerce, after-sales service, statutory or contractual obligations, protection of data subjects and relevant interested parties, marketing, customer management and service, and business within its registered activities or articles of organization.
In addition, to improve service quality, LOX records the webpages users click according to the nature of the services it provides. These records are used only for traffic analysis and online behaviour research to improve services on LOX-related websites and are not associated with specific individuals. If you sign in through LINE, the email address associated with that LINE account is accessed for sign-in identification.
